أهلية الأطراف
يهدف هذا الإجراء إلى تحديد أهلية الأطراف المتعاقدة على منصة سال لانسر، بما يضمن الامتثال للأنظمة السعودية ذات العلاقة ويعزز من الشفافية والوضوح في التعاملات الإلكترونية.
ثانيًا — نطاق تطبيق الإجراء والحالات التي يُستخدم فيهايُطبق هذا الإجراء على جميع الأطراف الراغبة في إبرام عقود عبر منصة سال لانسر، سواء كانوا أفرادًا أو كيانات اعتبارية، لضمان توافقهم مع المتطلبات النظامية للأهلية.
ثالثًا — الجهة أو الطرف المسؤول عن تنفيذ كل خطوةيتحمل كل من طالب الخدمة ومقدم الخدمة مسؤولية تقديم المستندات اللازمة لإثبات الأهلية، بينما تتولى المنصة التحقق من صحة هذه المستندات وفقًا للأنظمة المعمول بها.
رابعًا — خطوات الإجراء بالتفصيل، مرقّمة فرعيًا بالتسلسل الفعلي- تقديم طلب إثبات الأهلية عبر المنصة.
- رفع المستندات المطلوبة من قبل الأطراف.
- مراجعة المستندات من قبل فريق التحقق في المنصة.
- إخطار الأطراف بنتيجة التحقق.
يجب على الأطراف تقديم المستندات خلال 7 أيام من تاريخ الطلب، وتلتزم المنصة بالتحقق منها خلال 14 يومًا من استلامها.
سادسًا — الأدلة أو المستندات المطلوبة لبدء الإجراء أو إتمامهتشمل المستندات المطلوبة لإثبات الأهلية: الهوية الوطنية للأفراد، السجل التجاري للكيانات الاعتبارية، وأي مستندات إضافية تطلبها المنصة.
سابعًا — حالات قبول نتيجة الإجراءيُقبل الإجراء إذا استوفت المستندات المقدمة جميع المتطلبات النظامية وكانت صحيحة ومحدثة.
ثامنًا — حالات رفض الإجراء أو تعليقه وأسبابهايُرفض الإجراء في حال عدم تقديم المستندات المطلوبة، أو إذا كانت المستندات غير صحيحة أو منتهية الصلاحية.
تاسعًا — آلية التصعيد عند تعذّر إتمام الإجراء عاديًافي حال تعذّر إتمام الإجراء، يمكن للأطراف تقديم طلب مراجعة إلى لجنة الامتثال في المنصة للنظر في الحالة.
عاشرًا — حقوق الأطراف أثناء سير الإجراءيحق للأطراف الحصول على معلومات واضحة حول حالة طلبهم، وحق الاعتراض على أي قرار صادر عن المنصة.
حادي عشر — أثر الإجراء على الحالة التعاقدية أو المالية ذات الصلةيؤثر هذا الإجراء على إمكانية إبرام العقود عبر المنصة، حيث لا يمكن إتمام أي عقد دون استيفاء متطلبات الأهلية.
ثاني عشر — التوثيق والاحتفاظ بالسجلات المتعلقة بالإجراءتلتزم المنصة بالاحتفاظ بسجلات جميع المستندات والقرارات المتعلقة بإثبات الأهلية لمدة لا تقل عن خمس سنوات.
ثالث عشر — الامتثال للأنظمة السعودية ذات العلاقةيتم تنفيذ هذا الإجراء وفقًا لنظام المعاملات المدنية السعودي ونظام التعاملات الإلكترونية ولائحته التنفيذية.
رابع عشر — دور الذكاء الاصطناعي في دعم هذا الإجراء وحدودهيُستخدم الذكاء الاصطناعي في دعم عملية التحقق من المستندات، مع التأكيد على أن القرار النهائي يتم بواسطة فريق بشري مختص.
خامس عشر — قاعدة ختامية تحدد ما يحدث عند تعارض هذا الإجراء مع إجراء آخرفي حال تعارض هذا الإجراء مع أي إجراء آخر، يتم الرجوع إلى لجنة الامتثال في المنصة لاتخاذ القرار المناسب بما يحقق مصلحة الأطراف والامتثال للأنظمة.
This procedure aims to determine the eligibility of contracting parties on the SA Lancer platform, ensuring compliance with relevant Saudi regulations and enhancing transparency and clarity in electronic transactions.
Second — Scope of Application and Use CasesThis procedure applies to all parties wishing to enter into contracts via the SA Lancer platform, whether individuals or legal entities, to ensure their compliance with statutory eligibility requirements.
Third — Responsible Party for Each StepBoth the service requester and the service provider are responsible for submitting the necessary documents to prove eligibility, while the platform is responsible for verifying these documents in accordance with applicable regulations.
Fourth — Detailed Steps of the Procedure, Sequentially Numbered- Submit an eligibility proof request via the platform.
- Upload the required documents by the parties.
- Review of documents by the platform's verification team.
- Notify the parties of the verification result.
Parties must submit documents within 7 days of the request date, and the platform commits to verifying them within 14 days of receipt.
Sixth — Required Evidence or Documents to Initiate or Complete the ProcedureRequired documents for proving eligibility include: national ID for individuals, commercial registration for legal entities, and any additional documents requested by the platform.
Seventh — Acceptance Conditions of the Procedure OutcomeThe procedure is accepted if the submitted documents meet all statutory requirements and are correct and up-to-date.
Eighth — Rejection or Suspension Conditions and ReasonsThe procedure is rejected if the required documents are not submitted, or if the documents are incorrect or expired.
Ninth — Escalation Mechanism When the Procedure Cannot Be Completed NormallyIf the procedure cannot be completed, parties may submit a review request to the platform's compliance committee to consider the case.
Tenth — Rights of Parties During the ProcedureParties have the right to receive clear information about the status of their request and the right to appeal any decision made by the platform.
Eleventh — Impact of the Procedure on the Relevant Contractual or Financial StatusThis procedure affects the ability to enter into contracts via the platform, as no contract can be completed without meeting the eligibility requirements.
Twelfth — Documentation and Record Keeping Related to the ProcedureThe platform is committed to retaining records of all documents and decisions related to eligibility proof for a period of no less than five years.
Thirteenth — Compliance with Relevant Saudi RegulationsThis procedure is carried out in accordance with the Saudi Civil Transactions System and the Electronic Transactions System and its executive regulations.
Fourteenth — Role of Artificial Intelligence in Supporting this Procedure and Its LimitsArtificial intelligence is used to support the document verification process, with the assurance that the final decision is made by a specialized human team.
Fifteenth — Final Rule on Conflict Between This Procedure and AnotherIn the event of a conflict between this procedure and any other procedure, the platform's compliance committee will be consulted to make the appropriate decision that serves the interests of the parties and ensures regulatory compliance.
